In a landmark move for environmental justice in the Philippines, the Department of Justice (DOJ) and the Department of Environment and Natural Resources (DENR) have forged a powerful alliance to combat environmental crimes. On [date], Justice Secretary Jesus Crispin Remulla and Environment Secretary Maria Antonia Yulo-Loyzaga signed a historic Memorandum of Agreement (MOA) deputizing DENR lawyers as special prosecutors for environmental cases. Strengthening the Legal Arsenal Against Environmental Crimes


Environmental degradation, driven by illegal logging, wildlife trafficking, destructive mining, and marine resource exploitation, continues to threaten the country’s natural heritage. Despite stringent environmental laws, the prosecution of offenders has faced challenges due to limited legal resources and expertise. This new partnership seeks to bridge that gap by empowering DENR’s legal team with prosecutorial authority, allowing them to directly engage in environmental cases.


The MOA signing, witnessed by esteemed environmental lawyer Atty. Antonio Oposa Jr., signifies the government’s firm stance on environmental protection. Oposa, known for his groundbreaking legal battles to defend the environment, lauded the agreement as a major milestone in the country’s legal framework for environmental justice.


A Unified Front for Environmental Prosecution


Under this agreement, DENR lawyers will be deputized as special prosecutors, enabling them to assist in case build-up, prosecution, and trial of environmental offenders. This move is expected to enhance the speed and effectiveness of handling environmental cases, ensuring that perpetrators face swift and decisive legal consequences.


Justice Undersecretary Jesse Andres highlighted the broader impact of this collaboration, noting that environmental crimes are often linked to other illicit activities, including money laundering. "Criminal networks plunder our forests, exploit our marine resources, and drive endangered species to extinction—not just for profit, but to fund larger illicit operations. Stopping environmental crime is also stopping financial crime," Andres stated.


Addressing the Backlog of Environmental Cases


According to DENR reports, as of October 2024, over 6,400 environmental crime cases have been recorded across the country. Of these, nearly 27% remain pending with prosecutors, while around 38% have led to convictions. By integrating DENR’s legal team into the prosecutorial process, the government aims to significantly improve conviction rates and expedite case resolution.


Secretary Yulo-Loyzaga emphasized that this initiative aligns with President Ferdinand Marcos Jr.'s directive to hold environmental violators accountable. "We cannot fulfill that directive without this collaboration with the DOJ," she remarked.

Justice Secretary Remulla expressed hope that the institutionalization of this partnership will endure for generations, ensuring that environmental laws are upheld with the full force of the law. "This is not just a policy shift; it is a long-term commitment to protecting our environment for future Filipinos," he stated.
