Here is an open letter to the POEA Administrator and the DOLE Secretary concerning the issues of Virgin Job Orders, Shady Rules and Money-Making Schemes supposedly happening within POEA

Dear Admin. Olalia,
We would like to bring to your attention the ongoing impalement of the agencies under probationary period which is covered under the new POEA rules revised on April, 2016.
We understand that POEA has a vital role in implementing the government policy of providing full protection to Overseas Filipino Workers (OFW). And allow us therefore to acknowledge both the POLO and POEA for serving the needs of our OFWs in and outside the Philippines.
However, this is a fitting opportunity to raise our concern about the POEA rules particularly the upgrading of a provisional POEA license to a full license to the recruitment agencies.
In the POEA revised rules, the provisional POEA license agency must acquire at least 100 Virgin Job Orders and deployed 100 workers within two (2) years of operations. The condition for a Virgin Job Order is from a foreign principal who have an existing business registered at their respective country with more than one (1) year and have never engaged with any recruitment agency in the Philippines.
In the previous POEA rules, the Virgin Job Order is for any foreign principal who have not worked with any recruitment agency in the Philippines as well as the foreign principals that are registered at the POEA and have deployed workers to any recruitment agency but found inactive for 6 consecutive months.
This a clear concern that Some Board Members deliberately find an opportunity to complicate the process of Virgin Job Orders and there’s a big loophole - who benefits from this revision made by the
POEA?
There are various countries who deploy workers overseas and their government has no conditional clause pertaining to Virgin Job Order in the recruitment industry. This is yet an another “Only in the Philippines” contorted ways. We have this poignant unattainable requirement which pretense corruption inside the POEA. In our opinion, the whole Virgin Job Order should be abolished and probationary license to regular license must be based on 100 deployment without imposing a conditional validity.
As a recruitment agency (provisional or with full license), the POEA mandates that a recruitment agency shall set up an escrow account to cover possible future liabilities arising from claims of overseas contract workers due to employment contract violations. The release of escrow which is deposited in a POEA-accredited bank is ordered by either the POEA or the National Labor Relations Commission.
Recruitment Agency spends so much resources and efforts just to set up its operations. As you are aware, any business has an incubation period. Most of the investment done for accruing the licenses, office setup, staffing, overseas marketing expenses, etc, the return of investment (ROI) is estimated in 4 to 5 years’ time.
Please allow us to outline below how challenging it is to acquire Virgin Job Orders considering the market conditions for the past 3 years. The labor market has been drastically slow, this can be seen on the total Job Orders and deployment of the existing agencies have acquired.
Having said that, how much more challenging in getting Virgin Job Orders?
1. Virgin Accounts have hesitations in working with provisional POEA license agency as there is no solid track record yet. This is especially when we go after the big companies. Vendor Registration requires an excellent track record and they usually ask some client testimonials which provisional agencies do not have.
2. In relation to item #1, some foreign principals try to use this opportunity to their advantage to get a favorable recruitment fees which leads the agencies to a compromising situation. Some may even demand to a free recruitment cost due to lack of track record and credibility. Indeed a tough competition on Virgin Job Orders. The new agencies are forced to take the orders due to the time constraint preset conditions set by POEA. This is creating an unhealthy competition between the agencies and also an opportunity to compromise on the POEA deployment rules such as the documentation, insurance fees to be paid by the client and alike. POEA has issued more than 100 provisional license to recruitment agencies in the past 2 years. That being said, getting Virgin Job Orders is really very tight competition in the market with all the agencies competing to get the total 10,000 Virgin Job Orders. Now the news is spread in the existing labor market that there are many agencies who are willing to take job orders free of cost from Philippines including free ticket provided by agencies for deployment. Nevertheless to say the 100 Nos Virgin Job order scheme is adversely affecting the business of all the POEA licensed agencies.
POEA IS SETTING THE RULES AND FORCING THE AGENCIES TO BREAK THE RULES !!
3. Virgin Job Orders ideally comes from new market / country. This leads to another crucial step as we do not have POLO or Philippine Embassy in new market / country. The client with the help of the recruitment agency need to check the nearest POLO or Philippine Embassy that is within the jurisdiction of that particular country. Some clients may not be as cooperative because of this tedious process.
At times, POLO or POEA issues deficiencies which may also vary due to constant
changes in the rules. This back and forth, oftentimes prevents us in pushing through in getting a Virgin Job Order. Most recruitment agencies under provisional POEA license are doing every means possible and yet it will just be gone to be wasted. Currently, to accredit a Virgin Job Order from a new market is taking more than 3 to 4 months and much of the hurdles are faced at the POLO office nevertheless to point out upon verifying the documents and the delay at the POEA accreditation department now surpass more than 60 days.
On another note, we would like to know the stand and how POEA will address the following situations:
1. What will happen to the OFWs that has been deployed by the agencies with provisional license that has been expired and where not given the extension?
2. What will happen to the Virgin Job Orders and other principals that the expired agency acquired? If these foreign employers will just be taken granted, this will give a very bad impression with the Philippine Agencies & POEA.
3. During the probationary period the agencies are allowed to acquire any type of job orders. When an agency is suspended or canceled the other agencies can acquire these Job orders without assuming any responsibility on the deployment. The severity for deployment cases on Virgin Job Orders are more and the agencies are left out of business to handle this matter. POEA still can count on the escrow deposits and the Culprits inside POEA can make more money with various inside trading deals. This is just an icing to the other ongoing corruptions happening inside the POEA.
Evidently, POEA is ridden with termites just waiting for an opportunity.
3. Currently there are more than 100 Recruitment Agencies that are under the provisional POEA license. On a rough estimate, the recruitment agencies spent 20M to 30M on its 2 years operations
(100 x PHP30M = PH 3 Billion ). As per the new rule, if the recruitment agencies do not comply the condition of a Virgin Job Order their license will be cancelled, and all their efforts gone in vain with huge financial implication on the agency owners. We have solid information that some group inside POEA is using this opportunity to get all the leads on their clients and sell to the different existing agencies. We are aware of this inside trade as this has been a practice for a very long time. A convenient way for the corrupt inside POEA to extort more money from several agencies.
4. Currently there are agencies who have requested for an extension since January, 2018 of their provisional license but got denied based on the new rules. This has been the scenario for the last 8 months. The licensing department is keeping a blind eye on this matter and deliberately delaying a
resolution with various burocatic reasons. Furthermore, the grievances of the agencies have been addressed by the Private Sector Representative, Ms. Estrelita S. Hizon. She supports and recommends to the board to approve the request for extension of provisional license with a minimum number of 50 Virgin Deployment. If the respected board member in any way aware about the issues that the agencies are facing just to get the Virgin Job Order, she should recommend for an extension without any preset conditions. POEA should be aware about the intention behind this recommendation and request by this governing board member who also owns an agency business.
Moreover, we would like to bring this to your attention regarding a syndicate and their agents with the support of few Board Members, Directors and Officers from POEA threatening and extorting an exorbitant amount of money from the newly licensed agencies to fix the extension or to fix the provisional to regular license with various offers. All these point to the licensing department and the key decision makers there who are deliberately delaying an immediate resolution to end this money
making scheme at POEA. Any further delay, we will be forced to expose the names of the culprits benefiting from the 100 Virgin job order schemes.
We believe that your leadership on this matter would send a powerful message to the POEA that could prevent further mishap.
We respectfully ask you to urge the governing board members to uphold its responsibility to protect the OFWs as well as the recruitment agencies and employers, and to specifically ask POEA to take the following key steps:
● The condition in the provisional license pertaining to the 100 Virgin Job Orders should not be limited to 2 years or the Virgin concept should be completely abolished. There should not be a conditional clause of non-extension of license.
● There is a long back and forth thread about the issue and compliance between the agency and the employer. In this note, we made a lot of critical decisions because of the disruptive influence of requirements which we cannot able to see the importance of these requirements. It will only lead to employer’s decision not to hire a Filipino Workers that can result to significant rise of unemployment rate of Overseas Filipino Workers. To sum things up, it is a big risk because of this process and procedure. We believe that we are losing opportunities for the Filipino Workers because of the tedious procedure.
For some workers, going abroad is the only option. It can be improved significantly if only POEA can take a strong stand and commitment. Commitment in setting the rules by promoting Filipino Workers, providing fair rules to the recruitment agencies, and fast track the accreditation procedure. It’s very surprising that POEA is an ISO Certified organization and yet the turnaround time seems to be sluggish.
● We would also like to appeal for the revision on set rules for those agencies having provisional license where the 100 Virgin Job Orders are required. We believe that this is not vital in promoting Filipino Workers and getting employers across the globe.
The POEA must send a clear and powerful signal as the governing body that protects the interest for all the concerning parties as state above. We sincerely hope that we have conveyed a very exigent matter that needs your speedy action.
We are expecting an immediate intervention on the extension of the provisional license of these recruitment agencies who are not just affected but are also being exploited by the POEA Officials pertaining to the 100 virgin Job order scheme.

DeleteThis business is full of shit! We are constantly facing competing demands to other nationalities, sooner or later we will replace by Indian, Nepalese, Bangladeshi, etc. because of this system. How come we can get job orders from employers where this institution is eating our opportunities, delaying the process to get money. When greed comes in, logic comes out!

DeleteI understand the frustration of the people who wrote this open letter. I think other agencies should be able to understand the sentiment of the author of this letter. A 100 job orders is no joke. The most stable agencies can provide maybe but for small or start up agencies it can be a bit of a hassle.

Maybe you can make ammends naman with the agencies at hindi yung pag walang maprovide na 100 virgin job orders eh hingi nalang ng payment. If that is the case cut the 100 job orders requirement and just sell the license ar a certain price instead of extorting money.

Paki bilisan sana yung pag approve ng mga emoloyers at the same time mag focus sa POLO na sumuri ng employers, pag nasa poea na ang mga documents sana naman mabilis na maaprove. Not to mention pa dyan yung multiple accreditation policy, dapat dyan iabolish nadin kasi wala naman tulong yan policy na yan. Pinapahiraan nyo lang mga agencies na sila ang gumagawa ng paraan para mapromote ang mga filipino workers.
I'm also an OFW who usually coordinate with agencies sa pinas pag nagpapahanap employer ko dito sa Qatar. I can attest talagang malaki ang 100 job orders na hinihingi nila eh minsan naman 50 or less pa ang kaya ibigay ng employer namin.

You'll never hear an employer complains to Overseas Filipino Workers, BUT for the process of deployment, documentation, and procedures! We need to revamp the rules and regulations.
ReplyDeleteI GUESS THAT WAS THE FIRST RED FLAG, THEY COMPLICATE THE PROCESS TO TAKE ADVANTAGE IN DEALING WITH THE AGENCIES AND EMPLOYERS AND GET MONEY ON IT. 2017 WHEN I WORKED AS EXECUTIVE SECRETARY TO MY BOSS (SAUDI NATIONAL AND OWNER OF THE COMPANY) WHO ABOUT TO GET FILIPINO WORKERS IN OUR PARTNER AGENCY BUT UNFORTUNATELY BECAUSE OF THE LONG PROCEDURE, BACK AND FORTH DOCUMENTATION AND THE HELL OF WAITING, MY BOSS WAS FRUSTRATED AND CANCELLED THE VISA FOR FILIPINO, INSTEAD HE GOT WORKERS FROM BANGLADESH AND INDIA. ReplyDeleteThis is a pain in the neck! Agencies are the helpers that support POEA in promoting Filipino Workers, but how come POEA makes things difficult to the agencies??? It doesn't make sense at all. If this were not from agencies then POEA would gain nothing. It's like bitting someone's hand that feeds you.

DeleteGood Day mga Sir and Ma'am, I'm here to share my sentiment on this letter. I was a Marketing Agent from one of the reputable agencies in the Philippines. My job back then was to acquire business to promote Filipino Workers to the foreign employers. It was a dignified and honorable job almost that you're able to represent OFWs, providing efficient and qualified Filipino workers. Presenting to the employers was really a rewarding job for me almost that I know that Filipino can stand out in terms of quality of work, work ethics, trusthworthy and who always wear smile even the going gets tough thus the foreign employers really look upon us "Filipino". It was like selling a hot cakes (pardon for a lack of better words) but it's really easy to sell our services but there's always a big BUT! and you know what is it? it's about the POEA/ POLO procedures and requirements! this time employers were disappointed about the long and tedious process. To make the long story short, employers want Filipino workers but they don't want our system in the deployment procedure. Why it takes that long to process the application or register the company of the employers? POLO can do its customer due diligence as simple as that, when they finally checked and approved, what the hell is the long process going on in the registration phase in the POEA??? Don't you ever thought about us (as marketing agent) got a real deal to the employers that could open doors to Filipino workers who want to work abroad hoping for financial freedom. I salute to this open letter and I hope that our government could see the real value of this.

ReplyDeleteIt might sound completely over the top, leading to a loss of confidence of agencies to work on getting more employers overseas. I know others my fellow recruitment agency owners who have been in your situation and what they did? they can't help but to send money to the officials to get the license renewed and maintain the job orders they have. This is how the agencies cover up the inefficiency of the POEA. The long process and documentation are seriously bad! Admin Olalia, make a strong investigation on this and fix the sentiments of the agencies about the unjustifiable procedures!

If they asked for money say NO to them as simple as that! this is a signal of mutual respect. Maybe agencies feed those greedy officials. You might be part of it to blame
ReplyDelete@Don Marino, maybe you don't know what are you talking about about the real situation on this business. POEA has the upperhand to terminate, cancel, not renewing license or suspend agencies. POEA corrupt officials taking advantage of the situation and ask for money and leave the agency no choice. If the agency would not follow to the money making scheme then it's the end of its license and it cost them more than you ever thought. My point is , investigate the officials who ask for money and also develop the process, simplified, and systematize to avoid corruption along the way.

ReplyDeleteNow, let's focus on describing it in a way where I felt the importance of duties of the sector.
The Philippine Overseas Employment Administration (POEA) is an agency of the Government of the Philippines responsible for opening the benefits of the overseas employment program of the Philippines. It is the main government agency assigned to monitor and supervise recruitment agencies in the Philippines.
It's a crystal clear that the main function of POEA which is "responsible for opening the benefits of the OFW or promoting opportunties for filipino workers to work abroad -- ang linaw diba? the question then, how can the POEA gets employers across the globe? the answer mainly through agencies! though there are instances that government directly discuss and deal the job opportunities to the government of the foreign countries but again the main bloodline is through agencies!
On this note, agencies provide the big market share to POEA in promoting Filipino workers, now, what the sentiment all about is to keep an open door policy for those agencies who are doing their best and not stopping them by restricting the policies without any sense at all. Could you imagine, an agency who would venture to this business spend a huge amount of money in order to get clients across the globe? so why the POEA prevents or limits them? POEA should act to check the employers about how legit it is and also the welfare of OFW but if the agency for example submit job orders meaning they are submitting job opportunities to the Filipino workers.
POEA makes a complicated process on what basis? POEA should focus on the welfare of OFW, monitoring of Agencies and Employers but how come they spend more on approving job orders and renewing license of the agency who would like only promote Filipino workers?
Let's avoid pointing finger at anyone specifically but PLEASE listen and stop this baseless rules and deal with chronologically underperforming staff in doing their duties.

ReplyDeleteI'm an entrepreneur and I'm planning to start my own recruitment agency soon but these concerns made me worried about the left and right corruptions and disruptive policy, as I've heard to my friends from the industry money eaters are the officials and majority are in the management positions. Change the rules please admin,this business will open a huge opportunity to many filipino workers and we know the fact that Philippines is the human capital in the world so let's capitalise the strenght of Filipino workers and amend the rules according to ethical standard. What is the relevance of 100 virgin job orders for the probational license to become full license?please explain? And yet you require the start up agencies to deployed 100 workers in a year or so? Don't rush them because it might cause them find unqualified employers or worse push them to deal with the employers in providing free of charge fees that the workers would suffer for placement fees. This is a wrong practice to condition the start up agencies. Give them enough time,let them breath for a while and help them simplified the process of registering their employers and also their license. If you cant see the implication of this then it means you are doing a corrupt business inside POEA. Papahirapan nyo mga agencies para gipitin at kumapit sa patalim at magbigay ng pera para ma approve ang kanila license at mga naka bitin na job orders.

Corruptions involving duputies,evaluators,rank and file officers! All these might probably directed by the management.

ReplyDeleteThis corruption issue has taken from developing Philippine economy, you POEA staff should understand that without job orders no opportunity comes in for filipino workers. This is major disruptive to the growing community for OFWs. For sure it is taking place at all levels inside the POEA government.
ReplyDeleteThere are several issues in accreditation. For one, the nature of accreditation only puts pressure on those employers who are willing and able to undergo the tedious process. It has implications on the employability of Filipinos to safeguard and check their employers which is agreeable and fair to do so by POEA & POLO;however,problems complicates when officers of these entities involve in corruption. The authority has the capability to procastinate the process and in order for them to facilitate your accreditation, as agency you need to pay a huge amount of money if you don't want delays or disapproval of your accreditation. This is the ugly truth happening in POEA

POEA management is the obvious department to start to clean corruption and extortion that lead to a dead air process of licensing renewal and accreditation of foreign companies. When large chunk of documentations and gray timelime then corruption takes place. Give them money to solve issues back and forth but if you don't,you would end up like a headless chicken waiting and wondering without any results until your documents expire and your foreign employer does back out on your agreement and if you are a newbie player in the industry who happens to look after your probationary license then you are more likely at large to the corrupt people.This situation had really happened to my dear friend who lost his interest to invest in his humble agency.

DeleteI guess what I got into marketing is my passion in acquiring business. I'm working in a land based agency to get clients from Saudi Arabia, my clients are really enthusiasts to hire Filipino workers. I spent most of my energy on optimizing and reinventing manpower models and processes to fast track our business transactions with my clients. However,as far as my efficiency and dedication to get clients,I can't control the part where I have to register my client to the POEA. In this phase, problems and complains rise from the clients as it takes time plus the heavy documentations requiring from my clients. Not to mention the problem where POLO has different requirements compare to POEA. After compliance of my clients then deficiency comes back and forth, even though it supplied but it's actually mess up at the emd of the day. I don't know who are the staff of POEA/POLO, where they came from? What industry? I don't know. I only know the fact that they are incompetent and the y don't know systems at all no formal trainings I guess for their jobs which cause direct impact on the timeline process! Now, after I read the open letter, I felt frustrated tk the fact of corruption which I know it adds on the delays and disapprovals of client's registration. Clients are in the sunk cost fallacy they have no choice but to bear the dirty and long procedure

ReplyDeleteThis process of POEA for accrediting foreign employers involves both expense and delays with unfair amount of back and forth between the agency and foreign employers in complying documents and deficiencies which absolutely garbage! It often takes far longer and the sad part foreign employers were dissapointed with timeline. Should the administrator responsible for this?... it's a big YES!!!

ReplyDeleteI understand that rules and policies are there for a reason, it is only right that we have strict rules upon issuing a license. But I don't think that adding more complicated things like issuing a provisional license medyo pahirap na yan, kasi after all na nag comply sila sa requirements still you won't approve of a license na maayos, plus the fact that they might have complied to all the requirements then for faster transactions mag extort nalang ng pera. tsk! epic fail yan POEA.

Provisional license pwede nila gawin full license kahit hindi macomply ng agency ang walang basihan kondisyon ng renewal! Meron pa dyan yung mga papaso na ang lisensya tlga iipitin ka,hindo aaprubahan yung mga J.O. ng isang agency hanngang sa paexpire na ang lisensya at mawala na sya ng choice kundi maglagay. -True Story based from experience sa agency business

It's really a big help for us working in the recruitment agency reading comments with mutual thought on the challenges we are facing in the poea guidelines. I wish this will serve as steps towards fighting of corruption and revise the policy and requirements. I believe that agencies are the ones who truly help the promotion of Filipino to work abroad. Give us appropriate procedures without supressing our job orders from our clients by delaying the documentation or not.renewing our license. We are representing Philippine labor to the investors/ companies, help us levarage our position to showcase our credibility in commiting to our clients in terms of time frame and documentation. Simplify the rules make the procedure of registration as easy as 1 2 3.

Ang traffic sa lugar na ito kasi sobrang dami ng tao nagppunta,dinaig na ang prc pero kala ko karamihan ng mga tao nandoon ay mga applicante ofw or mag aabroad, kaya naisipan ko bumaba at mag apply at magbakasali nadin. Pagpasok ko sa loob bumungad agad sakin mga fixer na nag bbenta ng lagayan ng passport at tapos pag pasok sa gate si manong guard,ask sakin ng guard saan ako punta?sabi ko mag iinquire lang ng trabaho abroad. Malaman laman ko yung isa tao na halos kasabayan ko pumasok ang sabi nya ay mag aayos sya ng sss at pag ibig. Narealize ko na ang dami ng tao hindi sa mga ofw kundi sa mga ibang ahensya.ng.gobyerno.punta. of mapapansin ninyo kumokonti ang bilang ng ofw gawa ng wala ng job hiring sa pinas nagkakaubusan na dahil pla ito sa mga opisyal na corrupt. Opinion lang.
